What is the legal framework for aircraft hijacking?

The legal framework for aircraft hijacking is outlined in California Penal Code § 182.56. Under this provision, an individual is guilty of aircraft piracy if they unlawfully command, take, and/or use an aircraft with the intent to begin or continue flight without the consent of the owner, and with the intent to obstruct a lawful flight. This includes disabling, threatening, or otherwise taking control over the aircraft. The crime of aircraft piracy is a felony in California and carries a maximum sentence of life in prison with a minimum of seven years in jail. In addition to this sentence, an individual convicted of aircraft piracy is also subject to a substantial fine. The court may also order the person to take part in a rehabilitation program as well as to pay restitution to the victims of their crime. In addition to this, California Law also prohibits the sale, purchase, or transfer of any aircraft or aircraft parts stolen or hijacked by an individual as a result of their commission of aircraft piracy or other similar crimes. Such a violation is punishable by up to a year in prison and a fine of up to $15,000. By outlining clear and substantial criminal punishments for aircraft piracy in California, the state seeks to deter individuals from engaging in the unlawful and dangerous act of hijacking an aircraft. These provisions are designed to protect the safety of passengers as well as the personal property of aircraft owners.
