What is the legal framework for aircraft hijacking?
In Louisiana, aircraft hijacking is defined by the Federal Aviation Administration regulations. According to 14 CFR §49.5, aircraft hijacking involves the purposeful seizure or assertion of unauthorized control of an aircraft. This includes any aircraft owned or operated by the United States-or any aircraft within the United States-by force, violence, threat of force, or by any other form of intimidation. Under Louisiana law, any person who commits or attempts to commit aircraft hijacking can be charged with a felony which carries a penalty of up to 20 years in prison. For any penalties assessed, the court must consider the seriousness of the offense and the potential for harm to persons or property. In addition to criminal penalties, aircraft hijacking can also incur civil penalties. This could include a fine of up to $1,000,000 and/or a penalty of $10,000 for each day the offense occurred. The legal framework in Louisiana also provides for victims of aircraft hijacking to seek compensation for economic loss, emotional distress, and/or personal injury. Victims may be able to seek damages from the perpetrator and any co-conspirators who acted in procuring the illegal action. In sentencing those found guilty of aircraft hijacking, the court must consider the potential for deterring future occurrences. The court may also order punitive damages, restitution, and forfeiture of the aircraft involved.
