What is the scope of the Montreal Convention on International Air Transport?
The Montreal Convention on International Air Transport is an international agreement that sets out the rules and regulations for air transport across international borders. It was adopted in 1999, and applies to all carriers operating internationally. The Convention covers a wide scope of topics related to air transport, including the contracts between the carriers and the passengers, the rights of passengers, and the liability of carriers in the event of an accident. It also establishes the liabilities of the airlines for the personal injury and death of passengers, the damages to their luggage and other similar items, and the way in which any disputes between the carrier and passenger will be settled. Under the terms of the Convention, carriers are obligated to provide the necessary care and attention to passengers to ensure safety and comfort. This includes providing them with necessary documents, offering assistance during transportation and making sure their luggage is secure. The Convention also establishes which courts have the power to hear disputes and how carriers should respond to appeals from passengers. The Convention establishes an enforceable code of conduct for international air transport, and has proven to be an effective means of protecting passengers’ rights and providing for the safety of passengers. It has been adopted in almost 90 countries around the world, including by the U.S. in 2003 and by Louisiana in 2007.
