What are the regulations concerning airspace use by unmanned aircraft systems?
In Delaware, individuals are required to abide by all Federal Aviation Administration (FAA) regulations when operating unmanned aircraft systems (UAS) in the airspace. Generally, the FAA does not permit UAS to be flown within 5 miles of an airport without prior authorization, and drones may not be flown at altitudes higher than 400 feet above the ground, or higher than the tallest obstacle located within a 500 foot horizontal radius of the drone. Additionally, UAS operators should avoid flying near no-fly zones, such as military bases, government buildings, and other designated areas. When flying UAS in Delaware, operators must also be diligent regarding safety regulations. UAS must maintain a clear line of sight at all times and operators must pay attention to any air traffic or restricted areas within the vicinity of the drone’s flight path. Additionally, UAS operators must be certain that all of their flights are conducted safely and are compliant with all applicable regulations, including those concerning the maximum allowable weight of the UAS, as well as limitations imposed on the type of operations that may be conducted. Furthermore, UAS operators must recognize that their craft may be subject to search and seizure by local or state law enforcement officers if found to be operating in a manner contrary to Federal law.
