What is the scope of the Convention on Offences and Certain other Acts Committed on Board Aircraft (Tokyo Convention)?

The Convention on Offences and Certain other Acts Committed on Board Aircraft, also referred to as the Tokyo Convention, is an international agreement that sets out the scope of jurisdiction and criminal law for acts committed aboard an aircraft. This treaty applies to all aircraft regardless of country of registration and where the offense was committed. The Tokyo Convention designates that the country of registration has the primary responsibility to exercise jurisdiction over offenses committed aboard an aircraft. This includes the right to search and seize any aircraft, equipment, or cargo of the aircraft, and subject the offenders to prosecution. The Tokyo Convention also includes provisions for the extradition of offenders, mutual legal assistance, and the return of any seized items to their rightful owners. Additionally, the Convention covers any damage or destruction of the aircraft, as well as the responsibility to secure victim compensation in the case of an aviation disaster. In Kansas, the state has adopted the Tokyo Convention following the federal regulations and guidelines outlined in the Convention. Kansas courts have the authority to enforce and prosecute offenses committed on board an aircraft registered under the laws of Kansas. Additionally, Kansas law enforcement can exercise their authority to investigate and apprehend any offenders, as well as return any seized items.
