What are the laws regarding aircraft accident investigation?
In Delaware, the State Police are responsible for investigating all aircraft accidents and incidents. The Delaware Department of Natural Resources and Environmental Control (DNREC) is responsible for the investigation of aviation related environmental or hazardous material incidents. When an aircraft accident occurs, it is reported to the Delaware State Police who will then investigate the accident to determine the contributing factors. The investigation is conducted in accordance to Title 21, Chapter 59 of the Delaware Code. This chapter outlines the investigation process, requires aircraft owners, operators, and personnel to cooperate with the investigation, and provides rules for the disclosure of information. The investigation typically includes gathering and cataloging evidence, interviewing witnesses, visiting the crash site, obtaining maintenance and aircraft logbooks, assessing the weather conditions of the day, taking detailed photographs of the aircraft, and determining the cause of the accident. Depending on the severity of the accident, the National Transportation Safety Board may also become involved in the investigation. Once the investigation is complete, the Delaware State Police will issue a detailed report of the findings. This report will include the cause of the accident and any safety recommendations. The Delaware Department of Transportation may then take action to prevent similar accidents from occurring in the future.
