What is alimony?

Alimony (sometimes called “spousal support”) is a type of court-ordered payment from one former spouse to the other resulting from a divorce or legal separation. In Nebraska, alimony is awarded to the less financially secure spouse when both parties cannot be self-supporting, and is meant to cover living expenses such as housing, food, transportation, and medical care. Alimony can be paid in several forms, such as a one-time lump sum, periodic payments, or a combination of both. Alimony is typically seen as an obligation from the higher-earning spouse to the lower-earning spouse, and is usually paid until such time as the lower-earning spouse is able to become financially independent. In Nebraska, the court considers various factors in determining the amount and duration of alimony. This includes the length of the marriage, each spouse’s earning potential, any financial contributions made by either spouse during the marriage, and whether one spouse had to take time away from a career to look after the home or family. The court also takes into account any other financial obligations the couple may have. Alimony is also subject to modification over time, depending on the changing circumstances of the former spouses. Alimony can be reduced, increased, or terminated if the court finds that the former spouses’ financial situation has changed significantly or that one of the former spouses has remarried.
