What are the consequences of failing to pay alimony?

In Nebraska, failing to pay alimony can result in serious consequences. Legally known as alimony arrearage, failing to pay alimony can result in the party in violation to be held in contempt of court. This means the court has determined that the individual willfully and deliberately failed to obey the orders of the court. Other consequences for failing to pay alimony can include interest on arrearage payments, wage garnishment, liens on assets, or even jail time. In some cases, a court can also order reimbursement to the ex-spouse for attorney’s fees and court costs associated with collecting the alimony. Additionally, if the amount of unpaid alimony is sufficient and a judge feels that jail time is necessary to encourage the paying spouse to comply, the court can order that the delinquent spouse be incarcerated until the alimony is paid in full. Finally, the violating spouse may be required to provide proof of financial hardship in order to receive a temporary reduction or modification of the alimony payments. In the event that the delinquent spouse shows proof of financial hardship, the court will then re-evaluate and modify the alimony order in accordance with the person’s circumstances. In cases where a spouse fails to comply with the alimony order, there are serious consequences that can be enforced.
