Can alimony be paid in installments?
In Virginia, alimony can be paid in installments if agreed upon by both parties. The number of installments and the payment amounts must be legally documented in the court order, or divorce agreement. Alimony can also be paid in a lump sum. If someone is awarded alimony, it must be paid according to a schedule set up by the court. This schedule may include periodic payments, such as monthly or quarterly payments, or a single lump sum payment. The court may consider the financial situation of the parties when deciding whether to allow periodic payments or a lump sum. Generally, the more financially stable the parties are, the more likely it is that the court will allow for periodic payments rather than a lump sum. In addition, courts may modify an alimony order if the parties’ financial situations change. For example, if one spouse experiences a change in income that affects their ability to pay alimony as prescribed in the court order, the court will likely agree to modify the existing court order. Ultimately, it is up to the court to decide if alimony should be paid in installments or in a lump sum. Therefore, it is important for parties to work together to come up with a fair and agreeable payment plan if they decide to pursue alimony payments.
