Are alimony payments considered separate property?

Alimony payments, or spousal support, are payments made by one spouse to the other during or after the dissolution of a marriage. In Virginia, alimony payments are not considered separate property under state law. All alimony payments are considered marital property, just as a house, bank accounts, and other items of shared property are considered marital property under Virginia law. This means that, when dividing assets and debts in a divorce, any alimony payments made must be accounted for. This applies both to the payment, and to any tax deduction associated with the payment. In other words, any tax benefits associated with a payment made are to be shared between both parties in the divorce. In Virginia, courts are allowed to award both temporary alimony, to cover expenses during the divorce, and permanent alimony, to cover expenses after the divorce. Both types of payments are considered part of the marital estate, and are to be accounted for when dividing assets and debts. In short, alimony payments in Virginia are not considered separate property, and must be included in the division of assets and debts during a divorce. Alimony payments, and any tax benefits associated with them, are to be shared between both parties in the divorce.
