Does alimony terminate when the payor retires?

In Washington, alimony can terminate upon the retirement of the payor. However, if the parties have agreed to a specific duration in their marital settlement agreement, the order will not terminate until the duration has been satisfied. Additionally, if the parties agree that alimony is to terminate on the payor’s retirement, then the court will enforce that agreement. When the court is asked to make a determination as to whether alimony should terminate with the payor’s retirement, they will consider a variety of factors, including the length of the marriage, the age and health of the parties, the financial situation of the parties, and the standard of living that was enjoyed during the marriage. If the court determines that the recipient will suffer hardship as the result of the payor’s retirement, then the court may order alimony to continue. In Washington, alimony can be modified or terminated in certain circumstances, such as when the recipient cohabitates with another person, the payor becomes disabled, the recipient’s financial situation changes substantially, or if the payor retires. Ultimately, whether alimony terminates upon the payor’s retirement will depend on the agreement between the parties, the court’s determination, and the facts of the case.
