Is alimony modified if the payor's income decreases?

In Oklahoma, alimony may be modified if the payor’s income decreases. To do this, the recipient must first file a motion of modification with the court that issued the original alimony order. The court will then evaluate the payor’s income and potentially modify the alimony amount. In certain cases, the court may modify alimony without any action from the recipient. When this happens, it is referred to as an automatic reduction. An automatic reduction occurs if there is an increase or decrease in the payor’s income by 25% or more. The court may also modify alimony if the recipient experiences a substantial change in their financial circumstances. If a recipient’s income significantly increases, the court can order a decrease in alimony payments. If the recipient or payor is not able to meet the conditions of the original alimony order due to a change in financial circumstances, the court may decide to modify the alimony on a case-by-case basis. It is important to remember that alimony can only be modified in Oklahoma if the court finds that the recipient or payor has experienced a substantial change in their financial circumstances. Otherwise, alimony cannot be modified and must be paid according to the terms of the original order.
