Is alimony reduced if the payor earns less than the recipient?

In Delaware, alimony is sometimes called spousal support and is based on the couple’s need for financial assistance. Under Delaware law, alimony is reduced if the paying spouse earns less than the recipient. If the paying spouse’s earnings decrease, it is considered a substantial change in circumstances. This means that the court may modify the alimony order to reflect changes in each spouse’s financial situation. However, courts also consider other factors, such as the length of the marriage and the paying spouse’s ability to pay, prior to making a decision. The court also considers a number of other factors in determining alimony and any reductions. These include the age, physical condition, and mental health of both spouses; the length of the marriage; the standard of living at the time of the marriage; the couple’s employability; and each spouse’s income and expenses. The court also looks at whether either spouse contributed to the other’s education or professional development. In cases where the paying spouse earns less than the recipient, the court may decide to reduce the alimony amount, suspend payments, or terminate payments altogether. However, this is not automatically the case; the court will look at all factors before making a decision.
