Can alimony be awarded to a spouse who has remarried?
In Arkansas, alimony can be awarded to a remarried spouse under certain conditions. Generally, the court will only award alimony to a former spouse who has remarried if the financial circumstances of the former spouse has deteriorated significantly following the remarriage. This would be the case if the former spouse is unable to support themselves or is unable to meet their basic financial needs. The court also takes into account how long the former spouse has been receiving support from the new spouse. If the support is not indefinite and the remarried party can demonstrate that the economic factors have actually worsened after the remarriage, the court may uphold an alimony award.
