Are there any laws that protect animals from being trafficked or smuggled?

Yes, there are laws that protect animals from being trafficked or smuggled in California. The Endangered Species Act (ESA) is a federal law that prohibits the trafficking and smuggling of any plant or animal species that are listed as endangered. Additionally, there are state laws that enforce stiff criminal penalties for the trafficking and smuggling of wildlife. The California Penal Code 598.5 makes it a felony to buy, sell, acquire, or possess any animal or wildlife species that are listed as endangered or threatened under the ESA. The perpetrator can be subject to fines and/or prison time for being found guilty of the crime. In addition, the California Fish and Game Code also prohibits the buying, selling, taking, or possession of any species of plant or animal without a permit. Violators of this law face steep fines and/or imprisonment. The California Department of Fish and Wildlife is able to provide protection to animals from traffickers and smugglers. If a person suspects any illegal activity involving animals, they are encouraged to contact the Department of Fish and Wildlife to report the crime. Similarly, if a person is caught breaking any of the laws listed, they could face criminal charges.
