What is antitrust law?
Antitrust law is a type of legislation that is designed to protect consumers from unfair or illegal business practices, such as anti-competitive behavior and price-fixing. It is also known as competition law. In Texas, antitrust law is enforced by both the state and federal governments, though the main focus is on the federal level. At the federal level, the two main pieces of legislation are the Sherman Antitrust Act and the Clayton Antitrust Act. Both of these pieces of legislation were passed by Congress in 1890 and 1914, respectively. The Sherman Act prevents companies from fixing prices, limiting competition, or forming monopolies. The Clayton Act prohibits certain practices such as exclusive dealing or providing rebates for what are known as “interlocking directorates” which involve two or more companies having a common director or officer. At the state level, Texas has several laws that are designed to protect consumers from unfair business practices. The Texas Free Enterprise and Antitrust Act of 1983 is the main piece of legislation that guards against anti-competitive business practices. Additionally, the Texas Unfair Competition and Commerce Act of 1971It prohibits certain unfair practices, such as misrepresentation, fraud, and deceptive trade practices. Overall, antitrust law is designed to protect consumers from unfair and illegal business practices. It is enforced at both the federal and state levels. Such law has been in existence for around a century, in order to allow competition to flourish and ensure that businesses do not act in ways that put consumers at a disadvantage.
