What is the Robinson-Patman Act?
The Robinson-Patman Act is a federal antitrust law that applies in the state of California. It is designed to protect small businesses and consumers from predatory pricing practices by larger businesses. The Robinson-Patman Act was enacted in 1936 as an amendment to the Clayton Antitrust Act. The purpose of the Act was to protect smaller businesses, such as retailers and wholesalers, from large businesses that had the ability to drive down the cost of goods and pricing to a point where smaller businesses could not compete, thus leading to a decrease in competition. The Robinson-Patman Act applies to goods and services purchased by two or more entities that compete in a market. It prohibits companies from charging different prices to different purchasers of the same product or service if the disparate pricing reduces competition or creates a monopoly. It also prohibits companies from engaging in certain “tie-in” sales, which require the buyer to purchase goods or services at a certain price in order to acquire another product or service. The Act also prohibits companies from giving or receiving rebates or discounts that are not available to all purchasers of the same product or service. This is to prevent larger companies from buying goods or services at a discount and then reselling them to other purchasers at a higher price, thus creating an advantage and reducing competition. The Robinson-Patman Act helps to ensure that small businesses and consumers are not taken advantage of by larger companies who have the ability to manipulate prices. Thus, it helps to maintain competition and a fair market for goods and services in California.
