How do I appeal a court decision?
Appealing a court decision in Texas requires you to understand the appellate process. To begin, you must file a Notice of Appeal with the court that issued the decision you are appealing. This Notice informs the court that you intend to appeal their decision. Next, the appellant must submit an appellate brief (a written argument) to the appellate court. This brief must include the legal argument that you wish to make and explain why the court’s decision was incorrect. The opposing party will also file a brief. Once the briefs are filed, the case is set for oral argument before the appellate court. During oral argument, each side’s attorney will present the facts and legal arguments of their case to the panel of three appellate judges. The appellant will have the first opportunity to present its arguments, followed by the opposing party’s argument. After both sides have presented, the judges will deliberate and issue an opinion. This opinion will either affirm (agree with) or reverse (overturn) the lower court’s decision. Depending on the type of case, the appellant may be able to file a writ of certiorari to the Supreme Court of Texas. This request asks the Supreme Court to review the decisions of the appellate court.
