How do I appeal a court decision?

In Virginia, the process to appeal a court ruling is similar to other states. Generally, if you disagree with a lower court’s decision, you will file a Notice of Appeal with the court from which you are appealing. This notice must be filed within a certain time frame, as set by Virginia state law. After filing a Notice of Appeal, you must provide the other party in your case a copy of the notice and the records from the trial court. Next, you will file a petition for appeal with the corresponding court. This petition explains why you believe the lower court’s decision is incorrect and what changes you are seeking. After submitting your petition, the other party in the case will be given the chance to respond. After the court has reviewed the petition and any responses, they may allow oral arguments, which give each side the opportunity to explain their case in front of a judge. Once the arguments have been made, the court will issue a decision either affirming or reversing the lower court’s decision. If the appellate court agrees with your position, they will order the lower court to comply with the decision. If they disagree, the lower court’s decision will stand. Depending on the complexity of your case, the appellate process may take several months or even years.
