How does an appellate court decide a case?

An appellate court is a court that reviews the decisions made by lower courts to make sure that the law was correctly applied. In Mississippi, an appellate court is a three-judge panel that hears appeals from a lower court. In deciding a case, the appellate court will review the record of the lower court’s proceedings, the briefs filed by the parties, and any other relevant information. The appellate court will then consider the arguments made by each side. The court will evaluate the evidence and legal arguments of both sides and may ask additional questions. The court will decide whether the lower court correctly applied the law to the facts of the case. In the process, the appellate court may also consider how a similar case has been decided in the past. If the appellate court finds an error, it may affirm the lower court’s decision, reverse the decision, or remand the case back to the lower court with instructions to correct the error.
