What is the scope of review for an appellate court?

In Mississippi, when an appellate court reviews a case, they are examining the decision made in a lower court. This is called “scope of review.” An appellate court reviews a case to determine if the decision made in the lower court was correct. Appellate courts review the record of a case to determine if there were any legal errors made. This includes errors in the application of the law, errors in the findings of facts, and errors in the evidence presented. It is not the appellate court’s job to review the facts of the case and make new decisions. If the court finds any legal errors in the lower court’s decision, then it can reverse or modify that decision. Appellate courts also review cases to ensure that the defendant’s constitutional rights were respected. They look for evidence that the defendant was denied a fair and impartial trial. In some instances, the appellate court may also review a case to determine if there was sufficient evidence to support the conviction. The appellate court’s scope of review is typically limited and they consider only the matters that were presented to the lower court. The court will not consider any new evidence that was not presented to the lower court. The court will not review any evidence that was not made part of the record during the lower court hearings.
