What remedies can an arbitrator award?
In Texas, an arbitrator can award a variety of remedies to provide relief to a party in resolution of the dispute. These remedies can be monetary, a specific action, or a combination of the two. Monetary remedies can be awarded by an arbitrator in the form of compensatory damages, punitive damages, or attorney’s fees. Compensatory damages are awarded to compensate the party for the losses that they incurred due to the dispute, while punitive damages can be awarded to punish the other party and discourage similar actions in the future. Attorney’s fees can also be awarded if the arbitrator finds that one party was responsible for the dispute due to their failure to fulfill their obligations. An arbitrator can also order a party to take a specific action or to refrain from a certain activity. For example, an arbitrator may order a party to deliver property, perform a certain obligation, or even to cease certain activities that are found to be in violation of the dispute agreement. As an alternative to awarding these remedies independently, the arbitrator may also choose to combine various remedies or award them in combination with one another. For example, the arbitrator may order a party to pay an amount of money and to complete a certain action. It is ultimately up to the discretion of the arbitrator to determine the appropriate remedies to award in a dispute.
