How is an arbitration award enforced?

An arbitration award is the decision of an arbitrator, who is a neutral, impartial, third party selected by all parties involved in the dispute to decide a case. In Virginia, an arbitration award is a legally binding decision that can be enforced in court. To enforce an arbitration award, the prevailing party, the person or business who won the case, must file the award with the court. The filing party must then serve the opposing party with a notice of the filing. The opposing party may contest the enforcement of the award, but if no challenge is made within the 30-day timeline, the award becomes binding. If a challenge is made, the court may review the award to determine if there was any error made in the arbitration process, such as bias in the arbitrator’s decision or improper procedures. In Virginia, the court may modify or correct an award to ensure it is fair and in compliance with the law. If the court does not modify or revoke the award, they will then enter a judgment. This judgment is enforceable in the same manner as any other court judgment. If the opposing party fails to pay the award or comply with other terms of the agreement, the prevailing party can collect payment in several ways, such as wage garnishment, bank levies, or other legal means.
