Can an arbitration award be annulled?

Yes, an arbitration award can be annulled. In Virginia, annulment of an arbitration award is a legal remedy that can be sought under specific circumstances. In order to be successful in annulling an arbitration award, one must provide evidence that one or more of the following factors are present: the arbitrator exceeded their power or authority; there was a material irregularity in the conduct of the proceedings; the award was procured by corruption, fraud, or other undue means; or there was some other ground that renders the award void, such as a violation of public policy or unconscionability. If an aggrieved party is successful in annulling an arbitration award, then the award will be rendered void or unenforceable and a new arbitration on the same issues may be ordered. However, it is important to keep in mind that a court ruling to annul an arbitration award is a discretionary remedy that the court may choose not to grant. Furthermore, the court will be highly protective of the arbitration process and therefore may annul an arbitration award only if the party can provide substantial evidence of one of the conditions listed above.
