What is an artist's moral rights?

An artist’s moral rights are a set of legal rights that protect the interests of the creators of art. In North Dakota, these rights are secured by way of the Visual Artists Rights Act (VARA). Under VARA, an artist has the exclusive right to be identified as the creator of the work, the right to prevent the use of their name on any work they did not create, and the right to prevent the mutilation, distortion, or any other modification of the work that would be prejudicial to the artist’s reputation. Furthermore, VARA also provides the artist with the right to prevent the destruction of a work of recognized stature. This means that an artist can seek to prevent the destruction of their artwork or any modifications made to their artwork that would significantly harm the artist’s reputation. These rights are legally recognized and upheld by the courts in North Dakota. The purpose of these legal rights is to ensure that artists are adequately protected from any kind of unjust treatment or exploitation of their work. The moral rights provide protection to the artist’s interests and reputation and ensure that their art is respected and valued. Furthermore, it also helps protect the integrity of the artwork, ensuring that it is not changed or altered without the artist’s permission.
