What type of contracts are used to buy and sell artwork?

In Oklahoma, contracts are used to buy and sell artwork just like any other purchase. Generally speaking, contracts for artwork are quite simple compared to other legally binding agreements. Art buyers and sellers often use a basic contract that outlines the terms of the sale, including the price, description of the artwork, and other details. For more complex art transactions, parties may use a contract called a “Purchase Agreement” which specifies any conditions regarding the purchase. The agreement should include information about the artwork (description, size, medium, etc.), payment terms, shipping and delivery details, and insurance obligations. Any warranties about the artwork should also be laid out in the agreement. There are also certain types of art contracts specific to Oklahoma. A “Consignment Agreement” is used when a dealer agrees to sell artwork for the artist, and a “License Agreement” is used when an artist allows someone else to use their artwork for a certain purpose (e.g., reproduction or distribution). Both contracts include details about the rights of all the parties involved, as well as compensation and important dates. All art contracts should include a date of execution and the signatures of the buyer and seller as evidence of the agreement. It’s important to consult an experienced art lawyer to make sure the contract is legally binding.
