What is the Digital Millennium Copyright Act?
The Digital Millennium Copyright Act (DMCA) is a law passed in 1998 to protect copyright holders from potential infringements of their digital works. It is a United States law, and it applies to all states, including Nebraska. The DMCA criminalizes some copyright infringement activities, while also providing a procedure by which copyright owners can seek redress if their work is infringed. It also makes it illegal for someone to produce a technology, product, or service that can be used to circumvent technological measures used to protect copyrighted works. For example, it is illegal to produce a technology that can copy DVDs or CDs even if the copies are for personal use. The DMCA also provides immunity for online service providers from copyright infringements that they may unknowingly host on their servers. However, DMCA immunity may be lost if the provider has actual knowledge of infringement or fails to act quickly to remove the infringing material upon receiving a takedown request from the copyright holder. To sum up, the Digital Millennium Copyright Act is a United States law that protects copyright holders from potential infringements of their digital works. It makes it illegal to produce technologies that can circumvent copyright laws, provides immunity for online service providers, and has a procedure for copyright owners to seek redress if their work is infringed.
