What is the Digital Millennium Copyright Act?
The Digital Millennium Copyright Act (DMCA) is an important piece of legislation that helps protect creative and intellectual property rights in Oklahoma and around the world. The DMCA was enacted in 1998 and is an update to the United States copyright law that establishes copyright protections for digital works. The DMCA also provides immunity for Internet Service Providers and other online service providers from liability for copyright infringement by their users. Under the DMCA, copyright owners can submit take-down notices to websites and search engines that are hosting their copyrighted work without permission. The website or search engine must then remove the content. If the copyright owner then discovers the content on another website, they can submit a new take-down notice to that website. The DMCA also prohibits people from circumventing technological measures that are used to protect copyright works, such as copy-protection software. It also contains provisions that criminalize the production and distribution of technology that can be used to infringe copyrights, such as devices that can break copy protection. In short, the DMCA is an important piece of legislation that helps protect intellectual property in Oklahoma and around the world. It establishes copyright protections for digital works and also penalizes those who attempt to circumvent technological protection measures.
