What is a limited exclusive license?
A limited exclusive license is a legal agreement between an artist and a licensor. This type of license grants the licensor specific, limited rights to an artist’s work. These rights are determined by the terms of the agreement and typically include the right to reproduce, display, and distribute the artwork in a specific way. In Oklahoma, limited exclusive licenses are often used when artwork is developed for commercial use. For example, when a cartoonist creates a comic book character, he may grant a limited exclusive license to a toy manufacturer, granting them the right to produce and sell action figures based on the character. Another example of a limited exclusive license is when a musician grants a record label the right to release his music on a specified format, such as CD or vinyl. The artist can still sell the music on other formats, such as digital downloads. In Oklahoma, limited exclusive licenses must comply with Art Law. The artist must have clear documentation of the rights granted to the licensee, and all parties must abide by the agreed terms. Generally, the licensor retains some rights to the artwork, and the licensee can only use it for the specified purpose.
