What are the laws about loitering in parking lots?
In California, there are a few laws and ordinances that address loitering in parking lots. According to California Penal Code 653.6, it is illegal to “loiter, delay, or linger” on the property of a shopping center, parking lot, or other commercial establishment without any lawful purpose. Additionally, California Penal Code 602.1 prohibits loitering, sleeping, or loitering for commercial purposes in any lot or yard connected with or adjacent to a store, shop, or place of business within the state. Police officers and store managers can enforce these laws on the property they oversee. If someone is found loitering in a parking lot without a lawful purpose, they can be asked to leave the premises or risk an arrest or citation. Loitering laws in California also cover areas like hospitals, banks, and ATMs. Under California Penal Code 602.3, it is illegal to loiter “in or around any bank…or automatic teller machine” with the intent of committing a crime. In addition to state laws, there may be local ordinances or business regulations that further restrict loitering in parking lots. For example, a shopping mall or business may have its own rules about loitering on their property, similar to those listed in California Penal Code 653.6. Overall, loitering in parking lots is not allowed in California due to state laws and possible local regulations. Anyone found loitering in a parking lot without a lawful purpose may be asked to leave the premises or risk being arrested or cited.
