What are the laws surrounding aircraft accidents and liability?
In South Carolina, aircraft accidents and liability are regulated by the South Carolina Aeronautics Commission (SCAC) and the Federal Aviation Administration (FAA). Under these organizations, there are laws which dictate who is liable in the event of an aircraft accident. In the event of an accident, the SCAC has put in place a "strict liability" policy. This means that if an aircraft is involved in an accident, the owner of the aircraft is responsible for any resulting liability. The FAA also regulates who is liable in the event of an accident. According to the FAA, aircraft owners, operators, or their legal representatives, such as pilots, are liable for any damage or injury caused. In addition, South Carolina has also adopted a statute of limitations for aircraft accident claims. This statute states that any legal claims related to an aircraft accident must be filed within two years of the accident taking place. Failure to do so could result in the claim being denied. In the event of an aircraft accident, the liability may also be spread out among multiple parties. For example, the owner, operator, and pilot may each be held liable for the accident. In order to determine the exact liability of each individual, an investigation must take place. Finally, South Carolina has also enacted aviation insurance laws which require aircraft owners to purchase liability insurance in order to protect themselves in the event of an aircraft accident. These laws are in place to ensure that those who are injured in an aircraft accident are able to receive the compensation they are legally entitled to.
