Are there any debts that cannot be discharged in bankruptcy?

In Florida, bankruptcy is a tool to help individuals and businesses who are overwhelmed with debt. When a person files for bankruptcy, they become known as a debtor, and they are protected from collection activities by the court’s order. However, while bankruptcy can provide debt relief, certain debts are not discharged. Generally speaking, student loans, taxes, certain public record debts, spousal support, and restitution payments are some of the debts that cannot be discharged in a bankruptcy. Additionally, people who have obtained goods or services through false statements or fraud are not allowed to have those associated debts discharged. The bankruptcy court will also not discharge debt that was incurred by fraud, such as writing a bad check or using a credit card to buy items knowing that you cannot pay it back. Furthermore, people who have had debts discharged in a previous bankruptcy case cannot have those same debts discharged in a new bankruptcy case. Finally, any debts incurred as the result of willful and malicious acts by the debtor cannot be discharged in bankruptcy. There is more to learn about what debts are dischargeable and which are not depending on the specific situation. Those with questions should always consult with a qualified bankruptcy attorney to determine which debts can and cannot be discharged in a bankruptcy case.
