How long do I have to wait before I can file for bankruptcy again?

In Massachusetts, the amount of time you have to wait before filing for bankruptcy again depends on the type of bankruptcy you previously filed. If you filed a Chapter 7 bankruptcy, you will have to wait eight years before filing again. This is determined by the eight-year period of time the bankruptcy will remain on your credit report, after which you can file another Chapter 7 bankruptcy. If you filed a Chapter 13 bankruptcy, the time you must wait is determined by the amount of time it took for you to complete the repayment plan. If you were able to repay your debts through the repayment plan within three to five years, you may file a new Chapter 13 within two years. In the case that it took more than five years for you to pay off your debts, you may only file again after four years have passed. Before filing for bankruptcy again, it is important to consider all other options to manage your debts such as credit counseling, debt consolidation, or working out payment plans with creditors. It is also important to look into the types of debt you have, as some debt may not always be eligible for bankruptcy.
