How do I set up a non-profit organization?
Setting up a non-profit organization in the state of Colorado involves a few steps. It begins with choosing a name for the organization that is both unique and not already trademarked. After the name is chosen, the organization must be registered with the Colorado Secretary of State as a charitable organization or non-profit corporation. This requires filing the Articles of Incorporation, which will lay out the organization’s purpose and rules. After that, the organization must obtain a federal tax identification number (EIN) from the IRS. The organization should also determine its tax exemption status. Federal tax-exempt organizations must be created to promote social welfare, religious, charitable, scientific, literary, educational, or amateur sports activities. If approved the organization will receive 501(c)(3) status. To apply, the organization must file Form 1023, Application for Recognition of a Tax Exempt Organization Status. After all of the business formation paperwork is completed, the organization must also comply with the state’s rules for non-profits, including registering with the Colorado Department of Revenue and obtaining a Sales Tax Licence. The organization must also follow all of the state’s laws and regulations regarding non-profits. In addition, the organization should also create its own set of bylaws and policies to ensure that the organization operates in a manner consistent with their mission. This will help the organization remain accountable and ensure that it remains compliant with the requirements laid out by the IRS and the State of Colorado.
