What types of birth injury can occur during delivery?
Birth injuries can occur during delivery due to the difficult and strenuous process that labor and delivery can be. Common birth injuries include bruising, bone fractures, cerebral palsy, and Erb’s palsy. Bruising is caused by the baby receiving too much pressure or force when passing through the birth canal. Bone fractures are caused when the baby is pulled or twisted during delivery with too much force. Cerebral palsy is caused by a lack of oxygen to the baby’s brain during delivery that can lead to physical and mental disabilities. Erb’s palsy is a paralysis of the neck, shoulder, and arm, and can result from the baby’s shoulder being pulled during delivery. Other less common birth injuries include skull fractures and hemorrhaging. Skull fractures can be caused when a baby is too large for the mother’s birth canal, resulting in the baby being pulled out quickly and forcefully. Hemorrhaging can result from too much force applied during birth or from the baby not being delivered in a timely manner. In the state of Texas, birth injury law is defined under the Texas Birth Injury Liability Act of 1987, through which medical providers can be held liable for any injuries sustained as a result of medical malpractice.
