What is a birth injury settlement?
A birth injury settlement is a payment awarded to someone who has suffered an injury due to medical negligence during childbirth. These settlements can arise from a variety of different types of birth injuries, such as cerebral palsy, brain damage, hypoxia, and Erb’s palsy. In the state of Texas, a settlement can be reached through an out-of-court agreement between a plaintiff and a defendant. The settlement amount is based on a variety of factors, such as the severity of the injury, the amount of medical bills, and the emotional suffering of the family. In addition, punitive damages may also be part of the settlement, which is an additional amount awarded to punish the negligent party and to deter them from repeating their actions in the future. Before a settlement is reached, both sides will need to present evidence to establish the extent of the injury and to prove that it was due to medical negligence. A settlement is usually preferable than going to trial, as trials can be very expensive and time-consuming. Also, the amount of the settlement may be higher than what a court would award in a trial. Once a settlement is reached, the defendant will most likely have to pay the settlement in one lump sum or in installments, depending on the agreement. The settlement will be put in an account managed by a third party, such as an attorney, until the defendant makes the full payment. Once the payment is made, the money can be used to cover medical bills, therapy costs, and other expenses related to the injury.
