What is hypoxic-ischemic encephalopathy (HIE)?
Hypoxic-ischemic encephalopathy (HIE) is a form of birth injury that occurs when an infant’s brain is deprived of oxygen and/or blood flow. The infant’s brain cells are then affected, leading to death or permanent damage. It is also known as Asphyxia, which is when the body is deprived of Oxygen. HIE can be caused by a number of different factors, including labor and delivery complications, inadequate fetal oxygen levels, and inadequate blood flow to the brain during delivery. In some cases, HIE can be caused by medical malpractice, such as if a doctor was negligent in providing proper care or did not act quickly enough in response to a medical issue. When an infant suffers from HIE, it can lead to a range of long-term medical conditions, including cerebral palsy, mental retardation, epilepsy, and vision and hearing impairments. It can also cause developmental delays and behavioral issues. In New Jersey, parents whose children are diagnosed with HIE due to medical negligence can take legal action. They may be entitled to compensation for medical expenses, including the cost of ongoing medical treatment; lost wages; and pain and suffering. It is important to note that the statute of limitations for pursuing a birth injury lawsuit in New Jersey is two years from the date of the injury. Therefore, it is important for parents to take swift action if they believe their child’s condition was caused by medical negligence.
