What is a wrongful death claim and how can it be used in a birth injury lawsuit?

Wrongful death claims are civil claims that are used to seek financial damages when someone dies as a result of someone else’s negligence or wrongful act. In Delaware, a wrongful death claim may be used in a birth injury lawsuit if it can be proven that the death of the child was due to inadequate medical care or negligence on the part of a healthcare provider. For example, if a healthcare provider failed to properly diagnose a birth injury, such as cerebral palsy, or if a doctor failed to take appropriate action to treat the injury, then a wrongful death claim may be brought against that healthcare provider. In order to establish a wrongful death claim in Delaware, the plaintiffs must be able to show that the death of the child was the result of negligence or wrongful act on the part of the defendant. The plaintiffs must also be able to demonstrate that the deceased would have suffered a financial loss due to the death, such as lost wages or medical expenses. Additionally, the plaintiffs must show that the parents or guardians of the deceased have suffered a loss of companionship or support due to the death. Finally, the plaintiffs must be able to establish a causal connection between the negligence of the defendant and the death of the child. Once the wrongful death claim has been established, the plaintiff may be able to recover damages for medical expenses, lost wages, and pain and suffering. In some cases, the court may also award punitive damages to be paid to the surviving family members as a punishment to the defendant for their negligence or wrongful act that resulted in the death of the child.
