What is the Fair Debt Collection Practices Act?

The Fair Debt Collection Practices Act (FDCPA) is a federal law that helps protect consumers in South Carolina from abusive debt collection practices. The FDCPA was passed in 1977 and is enforced by the Federal Trade Commission (FTC). It applies to debt collectors who are collecting on consumer debts, such as auto loans, credit cards, medical bills, and student loans. The FDCPA outlines the procedures debt collectors must follow when collecting debts from consumers. These procedures include how, when, and where debt collectors can communicate with consumers. It also outlines the type of communication and language debt collectors are allowed to use when attempting to collect a debt from a consumer. Some of the language the FDCPA prohibits includes using profanity, threatening to take legal action against the consumer, and disclosing private information about the consumer’s debt. The FDCPA also outlines the rights of consumers when dealing with debt collectors. These rights include the right to dispute a debt, the right to request validation of the debt, and the right to request the debt collector to stop contacting them. The FDCPA also prohibits debt collectors from engaging in unfair or deceptive practices, such as trying to collect more money than is owed or falsely threatening to sue the consumer. The FDCPA helps protect consumers in South Carolina from unfair and deceptive debt collection practices. Consumers who feel that a debt collector has violated their rights under the FDCPA can file a complaint with the FTC or seek legal advice.
