What is the Unlawful Internet Gambling Enforcement Act?

The Unlawful Internet Gambling Enforcement Act (UIGEA) is an important federal law that regulates banking transactions related to online gambling in Tennessee and the rest of the United States. The law was enacted in 2006 as part of the Safe Port Act. It makes it illegal for any financial institution to knowingly accept or process payments for the purpose of online gambling. The primary purpose of this law was to prevent banks from processing payments for individuals to gamble online, as gambling sites are often located overseas and not subject to U.S. law. Under the UIGEA, banks and other financial institutions are required to prevent any funds originating from online gambling activities from entering or leaving the U.S. This includes banks blocking any payments to and from what are deemed by the Treasury Department to be “unlawful Internet gambling sites”. For the same reason, banks are also required to notify customers of any payments or transfers to or from such sites. Violation of the UIGEA could lead to significant fines or even criminal charges for banks and other financial institutions. In addition, the UIGEA also extends to other financial institutions such as payment processors and credit card companies. These companies are held responsible for preventing any illegal online gambling transactions and cannot process payments to or from online gambling sites. This helps to ensure that U.S. residents do not participate in activities such as online gambling that are illegal in the United States. The UIGEA is an important law that helps to regulate the banking transactions related to online gambling in Tennessee and the U.S. as a whole.
