What are the laws governing boating accidents?

In California, the laws governing boating accidents are established by the California Harbors and Navigation Code and the California Vehicle Code. Boating accidents must be reported if there is property damage of more than $500 and any injury or death resulting from the incident. The operator of the vessel involved in the accident is required to give their name and address, the type and registration number of the vessel, and the name of the owner, if known, to anyone who has suffered property damage or injury. California also requires any vessel involved in a boating accident to remain at the scene of the accident until a California Division of Boating and Waterways peace officer arrives. If the owner of the vessel is not present at the time of the accident, the operator must contact the owner as soon as possible and provide the owner with the same information. Additionally, the operator of the vessel must provide assistance, if possible, to any persons who may need it. This includes but is not limited to transporting any injured persons to the hospital, and providing medical services or other similar assistance. The operator may be held liable for failing to provide assistance in the event of an accident. California also requires anyone involved in a boating accident to file a formal report with the Division of Boating and Waterways. This report must be submitted within 10 days of the accident, regardless of fault. Failure to file a report could result in civil or criminal penalties.
