What are the laws governing boating accidents?
In Virginia, the laws governing boating accidents are similar to the laws governing car accidents. If someone is involved in a boating accident that results in injury or death, the incident must be reported to the Department of Game and Inland Fisheries within 48 hours. Drivers must have a valid boating license and obey all Virginia boating laws, including the safe operation of their vessel. The operator of a vessel is responsible for any damages or injuries caused by their operation of a motorized boat, vessel, or personal watercraft. All drivers must have an acceptable proof of financial responsibility (insurance) while operating a motorized watercraft, regardless of whether they are the owner of the vessel or not. Additionally, in order to impede the spread of aquatic invasive species, drivers are required to remove any aquatic life that is attached to the hull and propeller of the vessel, and must maintain a record of preventative maintenance. If a boat is used in a negligent manner, or if someone else’s property is damaged by a boat, the owner of the boat or the operator of the boat may be held liable for the damage. Lastly, it is a serious offense to boat under the influence of alcohol or drugs in Virginia. Boaters who are found to be boating under the influence of drugs or alcohol may face serious legal penalties, and may be found guilty of a felony in some cases. The legal limit for intoxication in Virginia is the same as for cars, which is 0.08 percent blood alcohol concentration.
