What are “catastrophic” brain injuries?
Catastrophic brain injuries are injuries that cause extreme, long-term physical and/or mental impairment that can be either permanent or temporary. In the state of Texas, catastrophic brain injuries are defined by the Texas Department of Insurance as injuries that cause “a total or partial functional disability that is permanent or likely to be permanent”. These injuries can be caused by a wide range of external or internal events, such as a traumatic brain injury, a stroke, a tumor or infection, or a lack of oxygen. Signs and symptoms of a catastrophic brain injury can include severe headaches, nausea, confusion, difficulty balancing or walking, memory loss, changes in behavior, and problems with speaking, understanding, and concentrating. Other effects of a catastrophic brain injury that may not be physical may include impaired judgment, communication and problem-solving skills. Once someone has been diagnosed as having a catastrophic brain injury, they may be eligible for compensation for medical costs, lost wages, or pain and suffering. Under Texas law, those suffering from a catastrophic brain injury may be able to seek compensation through a personal injury lawsuit, a workers’ compensation claim, or a claim under the Texas Wrongful Death Statute.
