What is the difference between a settlement and a verdict in a brain injury case?

A settlement and a verdict are both outcomes of a brain injury case, but they are quite different. A settlement is an agreement between the plaintiff (the person filing the case) and the defendant (the person being sued) to settle the dispute. The plaintiff and defendant can negotiate to decide on a fair payment to the plaintiff by the defendant. This payment is intended to resolve the dispute without going to trial. A verdict is a decision made by a jury or judge after a trial. The jury or judge hears evidence presented by both sides and makes its decision based on the evidence. This decision can be in favor of the plaintiff, or "for the plaintiff" and the defendant may be ordered to pay an amount of money to the plaintiff as compensation for damages. It can also be in favor of the defendant, or "for the defendant" which means that the plaintiff does not receive any compensation for their injury. Both a settlement and a verdict can result in the defendant paying compensation to the plaintiff for the injury caused. However, with a settlement both parties agree on a payment amount without going to trial and with a verdict a jury or judge makes the decision after a trial.
