What are the damages available in a burn injury case?
In Texas, burn injury cases can result in damages to the injured party. Damages are sums of money awarded by the court to compensate for injury, pain, and suffering caused by the defendant’s negligence or intentional misconduct. Generally, damages can be divided into two categories: economic damages and non-economic damages. Economic damages are intended to compensate the injured plaintiff for actual financial losses that occurred as a result of the injury. These damages can cover medical bills, lost wages due to time off work, loss of future earning capacity, property damage, and the cost of medical care to treat the injury. Non-economic damages compensate injured plaintiffs for less tangible losses such as emotional distress, pain and suffering, and loss of enjoyment of life. These damages typically involve compensation for mental anguish or physical pain caused by the injury. In a burn injury case, an injured plaintiff can pursue both economic and non-economic damages. The amount of damages awarded depends on the facts of the case, the extent of the injury, and the strength of the plaintiff’s case. In some cases, punitive damages may be available to punish a defendant whose actions were especially egregious or reckless. Regardless of the type of damages available, it is important to note that an injured plaintiff is not automatically entitled to damages. They must prove that the defendant acted negligently or with intent to cause harm and that the harm resulted from their actions. If successful, the court will award damages commensurate with the injury sustained.
