What are the legal restrictions on advertising?
In Colorado, businesses selling goods or services must comply with advertising regulations. They must ensure all advertising is truthful and not misleading, and they must not use false or deceptive claims to promote their products. Colorado law also requires that all advertisements must be conspicuously labeled, including the source of the advertisement and the identity of the advertiser being identified. It is also illegal to use false references, endorsements or testimonials in ads. For example, a business cannot create fictitious customer reviews or use endorsements from people or organizations without their permission. Additionally, businesses cannot run ads that directly or indirectly contain any form of discrimination, such as race, age, religion, gender, sexual orientation, or national origin. Businesses must also follow applicable rules regarding the use of logos, copyrighted works, and trademarked products and services in their advertising. They should also be aware of any regulations on the type of language used in ads that could be considered offensive. Finally, businesses must ensure that any advertising that includes minors has been approved by their parents or guardians.
