What are the fundamental legal rights of a child?
In Louisiana, children are legally protected by laws that recognize their fundamental legal rights. These rights include the right to have an advocate in court, the right to be notified of legal proceedings, the right to receive medical treatment and protection, the right to receive an education, the right to be supported financially, and the right to be protected from physical, emotional, and sexual abuse. Children in Louisiana also have the right to have their best interests taken into account in any court proceedings involving them, the right to have their views heard and taken seriously, the right to be provided with necessary medical, mental health, and social services, and the right to be reunited with their families whenever possible. In addition, children have the right to seek legal representation, to be free from prosecution as a result of their age and lack of capacity, and to have their personal information kept confidential. Finally, while the law allows for individuals under the age of 18 to be held responsible for their actions, they may be excused from criminal charges in certain circumstances. No matter what the case, Louisiana will always protect the fundamental legal rights of a child.
