What rights does a child have regarding medical care?

In Virginia, a child has the right to access medical care. Generally, this right applies to any type of medical care, from preventive care to emergency services. A parent or legal guardian is usually responsible for providing the necessary care, such as making and attending doctor’s appointments, obtaining prescriptions, and paying medical bills. However, if the child is 16 years or older, he or she may seek medical care without parental consent. In certain situations, the state may intervene if a child is not receiving necessary medical care. Depending on the situation, the state may decide to provide medical care for the child or provide assistance so the parent or guardian is able to access care. Additionally, a court may appoint a guardian to oversee the child’s medical care. In some cases, the Department of Social Services may also become involved if the child’s medical condition is serious and not being adequately addressed. Finally, a child has the right to refuse medical treatment and testing if he or she is of sound medical judgement and has sufficient understanding of the medical services being proposed. If the child is too young to make decisions, then the parent or legal guardian will make the decision for them. All medical decisions must be made in the best interest of the child and their overall health.
