What are the steps in a child custody dispute?

In Kansas, a child custody dispute is handled in the family court system. The process for a child custody dispute begins when one parent files a Petition for Child Custody or Modification of Custody with the court. After the other parent is served with a copy of the Petition, they have the right to file an Answer, agreeing or disagreeing with the terms, as well as a Counter-Petition. The next step is the Temporary Order, which establishes custody arrangements until the court can hold a hearing and make a final decision. This order can address issues of legal and physical custody, visitation, and child support. Next, the court will hold a hearing where both parents can provide evidence, call witnesses, and question each other. After the hearing, the court will issue a final order, in which it will decide the issues of legal and physical custody, visitation, and child support. If either parent is not happy with the court’s ruling, they can appeal to a higher court. If the dispute is still unresolved, the parents may be required to attend mediation or counseling to try to resolve their dispute. Finally, the court may issue an Enforcement Order if either parent is not following the court’s ruling.
