What legal rights does a child have when facing child support and financial hardship?

In Virginia, a child has certain legal rights when it comes to child support and financial hardship. For instance, under Virginia law, a parents’ monthly child support payment obligation cannot exceed 35% of their gross income. In addition, if the parent’s income is greater than $10,000 per month, the court may reduce the support obligation if necessary. Virginia law also requires parents to pay for “extraordinary expenses” related to the care of a child, such as medical expenses, daycare, and education fees. These payments must be agreed upon by both parties, and must cover the child’s actual costs. If a parent is unable to pay the full amount of child support, the court may modify the child support obligation. To be eligible, the parent must show that the change in circumstances has been substantial and permanent. Additionally, the court may require the parent to provide proof of income and other financial information. Finally, if the parents are unable to reach an agreement on the amount of child support, the court may enter an “order to show cause”, which requires both parents to appear in court so that the court can decide on the matter. In sum, Virginia provides legal protections for children facing child support and financial hardship. Parents’ obligations cannot exceed a certain percentage of their income, and they must provide for extraordinary expenses. The court can modify the child support obligation if the parent’s circumstances have changed, and the court can enter an order to show cause if the parents cannot reach an agreement.
